As Canada’s leading non-profit agency committed to increasing the use of automated external defibrillators (“AED”) through promotion, advocacy, education, and a centralized registry, the AED Foundation of Ontario (“we,” “us,” or “our”) takes privacy seriously and is committed to complying with applicable provincial and federal privacy laws in Canada, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”). .. 

This Privacy Policy advises visitors to our website, and other individuals with whom we interact (“you” or “your”) explains how we collect, use, disclose, and safeguard your personal information.

Your use of the website – which includes but is not limited to the submission of your personal information and/or AED data to the website – indicates your acceptance of this Privacy Policy and Legal Disclaimer and adherence to its terms and conditions as set out below.

By providing and/or allowing your personal and/or organizational information to be provided to the AED Foundation of Ontario, you consent to the terms and conditions of the within Privacy Policy and Legal Disclaimer and notably to the collection, use, and disclosure of your personal information by the AED Foundation of Ontario.

Your consent to the collection, use, and disclosure of personal information may be express (that is, where you were asked specifically for your consent, whether verbally or in writing) or implied (where you consent is necessary in order for us to provide the information or service requested), depending on the circumstances. Consent may also be provided in circumstances where notice has been given to you about how we would like to use your personal information and you have not withdrawn your consent, for example, by indicating that you would like to “opt out” of allowing us to use or disclosure the personal information for the purpose we had specified.

Please be aware that if you withdraw your consent to certain uses of your personal information, it may no longer be possible for use to provide you with certain information or services. Also, under certain circumstances, you will not be permitted to withdraw consent to certain necessary uses and disclosures of personal information that you have originally consented to. For example, we may be required by law to collect, use, or disclose (and store) personal information without your consent, to comply with other laws, an order of the court or other legal or administrative tribunal or body, or an authorized inquiry of a governmental agency. 

  

What Personal Information We Collect

Personal information is information about an identifiable individual, which includes name, title, address, phone number, email address, age, and other information as set out in the applicable federal and provincial privacy laws, including PIPEDA. 

The types of personal information that we may collect in carrying out our operations in Canada includes the following: 

· Name of individual and/or organization, postal address, GPS coordinates, facility name, email address, telephone number; 

· Internet protocol (“IP”) address and related particulars; 

· The name(s), contact information, and other identifying information of individual(s) within an organization responsible for the custody, maintenance, and storage of AED devices (i.e. the “AED Custodian”)

Technical or operational information related to AED devices being used by your organization, including AED model, maintenance and/or replacement schedule, and hours of availability for use.On a periodic basis, the AED Foundation of Ontario may also collect photographs, videos, documentation, or other forms of media in furtherance of improving the accessibility of AEDs through a central registry and 911 integration, promoting the use of AED through marketing and media messages, advocating for the use of AEDs through partnership and research affiliations, and the implementation of educational programs to entities in both the public and private sectors. 

Personal information may be collected in the following manner:

· When contact us or communicating with us via telephone, by mail, email, or facsimile regarding one of our services, websites, or promotion, advocacy, and educational initiatives and/or materials; 

· In your capacity as a healthcare professional and/or a representative of a healthcare organization; 

· Online while visiting our website or online initiatives, including information submitted via data forms and/or field queries; or 

  • When      using one of our electronic or mobile devices applications or tools; 

We do notcollect personal health information or data unrelated to AED registration and awareness.

Your use of our website does not generally require you to provide us with personal information. However, certain sections of our website may be restricted and may require registration prior to access. When you submit information to our website, you agree that we may collect, use, and disclose that information for the purpose(s) specified in those sections of the website and in accordance with the terms and conditions of the Privacy Policy and Legal Disclaimer. If you do not agree to these terms, please do not submit information to our website. 

Cookies

During your visit to our website, we may also collect information about how you are using our website, to help us improve the design and layout of our website so as to enhance your online experience. We do this through the use of “cookies” and other site-usage information technologies. 

“Cookies” are small text files containing a unique identification number that is automatically stored on the visitor’s computer. The information collected helps us determine traffic patterns and site usage, including the total number of visitors, whether a visitor is a new or repeat visitor, the types of internet browsers and operating systems used by the visitor, and information provided or received by the visitor. No additional personal information is stored in these “cookies”. 

We do not link this information to any other personal information that you may voluntarily provide to us at our website. How We Use Your Information

Personal and/or organizational information that we have collected may be used for one or more of the following purposes:

· To monitor interest in information contained on our website for marketing and/or research purposes and to make improvements to our website, its content, and ease of use

· To administer questionnaires, surveys, contests, or other discussion forums with a view of improving our services and outreach activities

· To respond to questions, feedback, comments, and submissions

· To follow up and/or otherwise gather more information on AEDs

· To maintain and update the electronic registry of AEDs in Ontario through the AED Foundation of Ontario’s centralized database

· To provide first responders or other emergency services providers with the location of AEDs as well as additional accessibility details in respect of AEDs and their use

· To create and update a map of publicly available and accessible AEDs in Ontario

· To conduct public health and safety research and awareness campaigns

· To otherwise comply with regulatory, securities, and other applicable laws

· To respond to Court or administrative orders, or to bring or defend against legal actions 

  

Disclosure of Your Information

We may disclose or transfer your personal information under the following circumstances:

· To Canadian and/or other domestic or international regulatory health and safety authorities as required

· To first responders as well as other emergency service providers (i.e. 911, EMS, etc.)

· To our affiliates, agents, and outside service providers, whom we require to assist us in carrying out our operations and who have agreed to protect the confidentiality of your personal information on terms that are consistent with those set out in this Privacy Policy and Legal Disclaimer. Such services may include data collection, processing and management, product order fulfillments, mailings, designing and conducting educational or other programs, and record storage and archival. Only personal information that is required to provide the service in question will be disclosed or transferred. 

· To a court, administrative tribunal, governmental authority or other body authorized to compel the disclosure of your personal information, for the purpose of complying with legal requirements such as a law, regulation, search warrant, subpoena, or court or administrative order, or as otherwise required or permitted by applicable law. 

· If the personal safety of users of our website or other members of the public may be compromised 

We do notsell or rent your personal information to third parties.

Please note that as any of these disclosures may involve the storage or processing of personal information outside of Canada and may therefore be subject to different privacy laws than those applicable in Canada, including laws that require the disclosure of personal information to governmental authorities under circumstances that are different than those than apply in Canada. 

  

Data Security

We have implemented measures designed to protect personal information in our custody and control. We maintain organizational, technological, contractual, administrative, and physical safeguards, including encryption and firewall, in an effort to protect against unauthorized and unlawful access, use, modification, copying, and disclosure of personal information in our custody and control. We have taken steps to ensure that the only personnel who are granted access to your personal information are those whose duties reasonably require such information.

Unfortunately, no collection or transmission of information over the internet or information storage is “100%” secure or error free, and therefore, we cannot guarantee absolute security of any such information. 

Your online access of certain of your personal information may be protected with a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls, or emails). 

The AED Foundation of Ontario takes privacy complains very seriously and has a procedure in place for escalating and managing privacy-related concerns to ensure that they are responded to in a timely and efficient manner. Any suspected privacy breach is escalated internally to trained members of the organization and/or third party service providers who oversee the containment, investigation, and corrective actions for the breach situation. 

  

Retention of Information

The AED Foundation of Ontario retains personal information for as long as necessary to fulfill legal or business purposes or for purposes of discharging and/or operating under the Registrar under the Defibrillator Registration and Public Access Act.

Once your information is no longer required by the AED Foundation of Ontario to administer its programs and services and meet legal or regulatory requirements, it is securely destroyed, erased, or made anonymous. It should be noted that residual information may remain in back-up for a period of time after its destruction date. 

  

Your Rights

You have the right to access, update, and correct inaccuracies in your personal information that is in our custody and control, subject to certain exceptions as prescribed by applicable law. 

You may request to access, update, and correct inaccuracies in your personal information that we have in our custody or control by emailing or writing to us at the contact information set out below. We may require that you provide sufficient identification information for the purposes of verifying the identity of any individual or organization seeking to access their personal information records. Any such identifying information will be used only for this purpose. 

We expect you, from time to time, to supply us with updates to your personal information, when required. We will not routinely update your personal information, unless such a process is necessary.

Our website may provide links or references to other websites that are not owned or controlled by us. These links are provided only as a convenience to users. The availability of these links does not constitute our endorsement of the linked sites. Therefore, we cannot be responsible or liable for any damages or injuries arising from information provided at these sites or your use of these sites, including your submission of personal and/or organizational information through these sites and how these sites may use or disclose your personal and/or organizational information.

This Privacy Policy and Legal Disclaimer does not apply to the collection, use, and disclosure of personal and/or organizational information by third parties, where the AED Foundation of Ontario does not have any control over the collection of personal and/or organizational information or over their respective privacy practices. We are not responsible for the privacy policies or content of the aforesaid third party platforms and strongly encourage you to review the privacy policies of every third party platform you visit that gathers personal and/or organizational information.
